Terms of Service

#Who provides Tobs

These terms are between you and YANG MUFENG, an individual operating Tobs under the BotHarness organization name ("we", "us"). BotHarness is an organization name, not a separate incorporated company. Contact us at yang@deepseekbot.app.

These terms cover the Tobs website, mobile app (previously called DeepSeekBot), and the Tobs account and Connect services we operate. By using these services, you agree to these terms. If you do not agree, do not use the services covered by them.

#Open-source software and third parties

Tobs open-source software remains governed by its MIT license and any applicable third-party licenses. These terms do not restrict rights granted by those licenses, including running, modifying or redistributing the software. Operating your own copy does not make us the operator of your computer or your deployment.

DeepSeek Harness, model providers, app stores, messaging platforms and other third-party services have their own terms and privacy practices. You must have the permissions and accounts required to use the providers and integrations you choose. We do not operate those third-party services.

#Who may use the services

You must meet the age and legal-capacity requirements for using these services where you live. If you are a minor, you must have your parent or legal guardian's consent where required by law. If you cannot legally agree to these terms, your parent or guardian must agree on your behalf. If you use the services for an organization, you must have authority to act for it.

#Accounts, devices and connections

Keep your account, devices, pairing links and credentials secure. Only connect computers, accounts and services you own or are authorized to access. Review pairing requests and the permissions you grant to Bots, tools and other devices. Tell us promptly if you suspect unauthorized use of your Tobs account.

The mobile app connects to your own computer. Bots, Memory and the main conversation history live there; some data is also stored on your phone. Optional Tobs Connect helps link accounts and computers and provides a connection route. Availability depends on your computer, network and the services involved. We do not promise uninterrupted connectivity or a backup service for your files. Keep your own backups.

#Your content and AI actions

You keep any rights you have in content you provide. We do not claim ownership of your conversations, files or Memory. You give us only the permissions needed to process content you submit to the services we operate, in order to provide those services as described in our Privacy notice.

AI output can be inaccurate, incomplete or inappropriate. Review it before relying on it. Generated output is not a substitute for qualified medical, legal, financial or other professional advice, and we do not guarantee that it is unique or free of third-party rights.

Depending on the permissions you grant, Bots and tools can run commands, change or delete files, access external services and send messages. Check requests carefully before granting access or approval. You are responsible for the instructions and permissions you provide and for using output lawfully; this does not remove our own responsibilities under applicable law.

#Acceptable use

Do not use our services to break the law, infringe others' rights, distribute malware, gain unauthorized access, deceive or harass others, or compromise the security or availability of the services. Do not submit content or grant access that you have no right to provide. Security research must respect others' data and systems; report suspected vulnerabilities to our contact email.

#Prices and outside costs

We currently do not charge for the services covered by these terms. Your chosen model providers, hosting providers, network operators or other third parties may charge you separately under their own terms.

If we introduce paid services, we will disclose their prices and applicable payment, cancellation and refund terms before you choose to purchase. These terms do not authorize automatic charges or enroll you in a future subscription.

#Privacy

Our Privacy notice explains data handling, optional accounts and connections, usage statistics, notifications and account deletion. Review it before sending personal or sensitive information or enabling optional services.

#Stopping use and service changes

You may stop using the services at any time. You can unpair devices and, if you have a Tobs account, use the account deletion process described in the Privacy notice. Deleting an account does not delete Bots or files on your own computer, or automatically revoke independently paired devices.

We may restrict or suspend access to the services we operate when reasonably necessary to address a breach of these terms, a security risk or a legal requirement. Where reasonably possible and lawful, we will explain the reason and give you an opportunity to resolve it. You can contact us to question a restriction.

Features may change or be discontinued. For material changes to or closure of our account or Connect services, we will provide reasonable advance notice where practicable, except when urgent security or legal reasons require earlier action. You retain your rights under the applicable open-source licenses.

#Availability, liability and your legal rights

We aim to provide useful services, but do not guarantee error-free AI output, uninterrupted availability or compatibility with every device or third-party service. Open-source software warranties are addressed in its applicable license.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or for death or personal injury caused by negligence. Nothing removes mandatory consumer rights, statutory guarantees or remedies you have under applicable law, including in the European Economic Area and the United Kingdom. Liability otherwise follows applicable law; these terms set no fixed monetary liability cap.

#Changes to these terms and disputes

We will publish updated terms here with their effective date. For material changes affecting existing account or Connect users, we will give reasonable advance notice through an available service or contact channel and seek consent where required by law. Changes will not apply retroactively. If you do not agree, you may stop using the affected services.

Please contact yang@deepseekbot.app with questions, complaints or disputes. These terms do not require arbitration or designate an exclusive court. Applicable law determines governing law and jurisdiction, including any mandatory protections and rights to bring claims where you live. The Chinese and English versions express the same terms; neither overrides mandatory legal protections.
